Commentary: It's Time to Re-think Oral Argument Top
Today's appellate oral arguments are the miniaturized descendants of much heftier beasts, writes Martin J. Siegel. Yet as the time devoted to oral argument and even its basic reason for being have changed, its archaic format hasn't. Some experimenting may now be in order. Given the modern purpose of appellate argument, lawyers often are urged to be conversational, he says.

Joey Asher says that, sometimes, when he's listening to a business presentation, he wants to shout "Dude! This isn't 'Star Trek.' And you are not Mr. Spock. So why don't we stop with the mind meld?" Many business presenters seem to think that they are capable of performing a mind meld with their audience. They seem to think that their job as a presenter is to stand in front of the room with 60 slides and download all their information onto their listeners' hard drives.
