Barratry Bills Impose $10,000 Civil Penalty, Expands Contract Voidance | Top |
A bill making its way through the Texas Legislature creates a civil cause of action for barratry, including a $10,000 civil penalty for lawyers who unlawfully solicit potential legal clients and do not sign a contract with them. The law also would allow clients to sue to void any type of contract a lawyer secures through barratry, although current law allows voidability of only contingent-fee contracts. Sen. After a former client allegedly failed to repay all of a $160,000 "loan," Dallas-based Winstead filed a suit in March seeking to recover an unpaid balance totaling nearly $100,000. Don Campbell, a shareholder in Dallas who is Winstead's general counsel, alleges former client J.C. "Chris" O'Neill owed the firm fees, so O'Neill, at the firm's request, signed a promissory note in June 2008 for $160,000 to cover the debt. However, Winstead alleges in the March 7 petition that O'Neill failed to repay $99,626 of the loan. | |
