The first issue for mandamus relief is whether the judge has committed a clear abuse of discretion, writes Jim Moseley, a justice on the 5th Court of Appeals in Dallas. A judge has no discretion in determining what the law is or in applying the law to undisputed facts, even when the law is unsettled. So an error in doing either constitutes a clear abuse of discretion. However, resolving a contested fact issue cannot constitute an abuse of discretion. | |
